Touring with adesum

Our interest is that you have a unique experience. The adesum experience is designed for small groups in chauffeur driven transportation and you will not travel with people you don´t know, unless that is what you want of course. Remember that we do not offer airline tickets and that we do not include nor accept self-drive tours.

By making a booking with adesum travel sl. (from now adesum) you will be bound by the terms and conditions. These will form the basis of the contract between us and yourself, the Group leader (including any other person named on the booking form, or anyone who subsequently joins your Group). What we call “adesum experience” or “tour” includes all services that you book through us but excludes any part of the trip that is booked directly with other suppliers.

The booking process

  1. The process starts with your interest in our travel philosophy. You have access to our contact form or our email info@adesum.com in order to get in touch with us. In our website you will find a sample of the type of services we offer and our mission in life. When you get in touch with us you ideally should give us some idea of what you want (at least the dates, number of people and main interests).
  2. From your first query we will send you by email an initial Detailed Booking Form for you to fill in, in which we will ask you MANY more things. Once we receive this document back we will combine some proposals for your review in our informative Ideas & Proposals Doc and will send them to you by email. We feel that this is an extremely important part of the booking process…the more we know about you, the better we can fulfill your expectations. We will finalize this part of the process with a phone call and with your sending back to us of the final Detailed Booking Form in order to make sure we have everything right and in writing.
  3. Once we know your preferences, you are satisfied with the customized proposal and we have all booking information from you, we will then issue two documents: a final Experience Itinerary, a Booking Contract and an Invoice with the total value of your adesum experience. You should then review these documents and provide your agreement with them: by emailing back to us with them signed and by making a first payment in Euros for deposit of 30% of the total value on our payment site with VISA or Mastercard or alternatively by Bank Wire.
  4. This documentation and deposit will serve as your reservation and agreement to this Terms and Conditions. We will send you a Notification of Receipt of the documentation and first payment with instructions on next steps with regards to the balance of the payment.
  5.  The rest of your Invoice must be paid within 60 days prior to departure using the payment methods described earlier and an email notification to us with the details. If start date is less than 60 days away, payment is due in full. Please note that adesum cannot ensure that all services will be available with bookings of less than 60 days and reserves the right to not accept the booking under these Terms and Conditions.
  6. Please review and verify your Booking Contract and Invoice thoroughly and contact adesum immediately if your invoice appears to be incorrect or incomplete, as it may not be possible to make changes later. adesum cannot accept responsibility if we are not notified of inaccuracies within 10 days of sending out the invoice. In the case of billing errors, adesum reserves the right to re-invoice you with correct pricing.


For the group leader. If you are booking on behalf of a Group, your additional responsibilities are:
(i).To ensure that all members of the Group are informed about the booking details and that all members of the Group are bound by these terms and conditions.

(ii).To take full responsibility for client side administration, special request etc and be responsible for the accuracy of information supplied, both prior to the booking and up until after the event has elapsed.

(iii).To ensure that adequate insurance cover is acquired by the Group members.

(iv).To agree and progress with all payment timetables as set out above and on the booking form.

(v).To ensure that all members of the Group comply with the schedules and timetables of the booking. Failure to keep to the timetables may result in either shorter visits or cancellations of visits. We will not be liable for any refund, compensation or any other costs that may be incurred.

 All travelers with adesum are subject to the Participation clause under the Terms and Conditions.


 Important notes:

TheBooking Contract forms the legal agreement between you and us and governs the terms on which services are offered and sold. Nothing in www.adesum.com, other documents or our brochures shall constitute an offer of goods or services. No contract shall be formed between you and adesum until we issue such confirmation of your booking.

· adesum will not accept charges for international payment. Remember payment should be made in Euros.

· The Group leader, in representation of the Group, accepts that e-mail is a satisfactory means of communication of any correspondence between the parties (changes, cancellation etc). Separate booking confirmations for each member of the Group will not be made and correspondence will only be sent to the Group leader

Changes

Should you wish to alter a booking (i.e. change dates, accommodations or activities arranged on a custom basis) you must notify us in writing as soon as possible and adesum will make reasonable efforts to comply with such requests; however, you will be obliged to pay for any additional expenses resulting from such changes. In addition, we may charge, upon our sole discretion, an amendment fee of up to a maximum of 100 Euros per person to cover administration costs incurred. If the change is decided once the tour has commenced, we accept no liability for any loss, damage or additional expenses arising therefrom; and we cannot guarantee a refund of any costs paid by the client.

Chargeable changes include but are not limited to: change in number of guests, changes in travel times, changes in names of those travelling, changes in dietary requirements, etc. If we are unable to make any requested change and you do not wish to continue with the booking then our cancellation charges will apply. The following changes will be treated as a cancellation of your holiday by you; your amended arrangements will then be treated as a new booking.

· A change of the start date of your trip by more than two weeks

· A reduction in your holiday duration where requested after balance due date.

If you or any member of your party is prevented from travelling, you may change your booking up to 14 days before departure by transferring it to another person providing the person to whom you wish to transfer the trip meets any conditions which may apply to it. The right to transfer is subject to a payment of an administration fee of up to 100 Euros per person, and the payment costs incurred in making the transfer.

adesum reserves the right to modify the activities and activity suppliers, wineries listed, hotels and restaurants detailed in the itinerary, according to availability and with the commitment to find alternative choices of equal or greater category.

Cancellation policy

Due to our focus on excellence adesum travel cannot make exceptions on its cancellation policy. If for a certain reason you are forced to cancel your trip with us, our policy is as follows:

· More than 60 days prior to departure: we will refund your deposit less a 100 Euro administration fee per person. If you have paid the invoice in full before 30 days prior to departure: we will refund the full amount less your deposit.

· Less than 30 days, we do not forward refunds.

· adesum is not responsible for expenses incurred in the eventuality of cancelled trips, such as airline tickets, and we suggest taking out trip cancellation insurance (see below). There is no refund for arriving late or leaving a trip early.

· adesum will not refund or cover any cost or expenses incurred for termination of tour arrangements due to unacceptable behavior.

· For one day excursions, the client will receive a full refund for cancellations that are made 7 business days prior to the excursion date, less a 100 Euro administration fee per person plus any applicable bank charges. No refund shall be made for cancellations made less than 7 business days in advance of the excursion date.

· Some tours or corporate events may be subject to a different cancellation policy which shall be provided to the client in writing prior to contracting services.

If the Group needs to cancel the booking once we have received the agreed Booking Contract, the Group leader must contact us as soon as possible, initially by phone when we will advise you of any cancellation charges and then the Group leader should confirm your intention in writing (email or letter). We will not treat a booking as cancelled until we receive your written confirmation and cancellations shall be effective on the next business day after receipt of written notice.

If some members of your Group cancel, those cancelling are subject to charges described earlier and we reserve the right to change the price for remaining members of the Group based on the revised Group size.

Participation

In order for this contract to be legally binding, anyone making a booking with us must be at least 18 years old. Minors must be accompanied by a parent or guardian who will assume full responsibility for his/her conduct and safety. Some Wineries do not allow children less than 12 years old to enter their facilities on tour. In this case it will be responsibility of the parent or guardian to take care of the minor during the activity. Each tour participant is individually responsible for: arriving at the tour departure point on time and abiding by the laws of Spain during tour.

Travelers who have special dietary requirements should make that clear at the time of making the booking in order to make the necessary arrangements. adesum will make all efforts possible to accommodate but cannot guarantee the correct service otherwise.

You must report any participant with disability, requiring special attention while on tour, at the time the reservation is made. adesum will make reasonable attempts to accommodate the special needs of disabled travelers, but is not responsible in the event it is unable to do so nor responsible for any denial of services by wineries, hotels, restaurants, or other independent activity suppliers. adesum cannot provide individual assistance to a vacation participant for walking, dining, getting on and off vehicles, or other personal needs. A qualified and physically able companion must accompany travelers who need such assistance and must assume full responsibility for their well being. You should check at the time of booking whether the tour is accessible to you. We are unable to accept any conditional bookings based on special needs being met and reserve the right to not accept your booking if we are unable to meet your request.

All members of the Group should act at all times in a safe, responsible and courteous manner, comply with all safety procedures (for the avoidance of doubt this includes an appropriate level of sobriety), listen and be present at all safety and information briefings relevant to any special activities, make supervisors or any person in authority immediately aware of any equipment or site deficiencies or concerns, dress and/or equip themselves suitably for any event or activity as advised by adesum and/or its suppliers (failing which as is deemed appropriate or suitable in the circumstances), and observe and obey all laws, requests (including the signing of any disclaimer) and conditions of use of any supplier, including accommodation, activity centers and entertainment venues.

adesum reserves the right to accept or reject any participant and to remove any participant whose conduct is deemed incompatible with the interests of the other participants. adesum or its suppliers may end or cancel an activity, with no liability of reimbursement, if the behavior of the Group or that of any person associated with the Group is likely in the opinion of us or our supplier’s to cause distress, damage, danger to or to annoy other customers, or other members of the Group, employees, property or anyone else. If Groups behave in such a way that results in the supplier’s relationship with us being terminated, clients will be pursued for compensation by adesum. If the Group is prevented from travelling because any person in authority thinks any member of the Group appears to be unfit to travel or likely to cause discomfort to or disturb other passengers, we will not be liable to complete the booking arrangements, and will not be liable for any refund, compensation or any other costs incurred by the Group. In some instances Groups may be required to sign agreement forms and or provide a damage and or behavior deposit. If any occurrence of damage is obvious, Groups will be pursued for recovery for the full amount of damage reimbursement, associated costs and any expenses incurred, including time and administration, in pursuing this recovery.

If you arrive at any part of the tour with an increased number of guests, the new guests will not be covered by us and may not be able to join the activity or event.

Insurance & documentation

Travel insurance, medical insurance and cancellation insurance are not included in the cost of the tour.

We require that each tour member obtain appropriate travel and medical insurance coverage which extends to Spain before touring with us. adesum will not be liable for any expenses incurred because of a client’s failure to obtain appropriate insurance to prevent financial loss in case of a personal emergency, illness, accident or any other circumstances causing you to cancel your trip and subsequently lose your deposit, trip payment, and other travel costs. We ask that you review the limited amount of the coverage included in your individual insurance package and confirm that you are adequately covered for any eventuality. When you book a tour, adesum will acquire limited travel assistance insurance. Travel assistance does not include unlimited medical insurance nor does it cover any property damage, loss or theft.

All travelers should bring passport, and visa if required (ask us if you have any doubts about this, entry requirements vary country to country). In addition to this we suggest bringing an additional photo ID, as well as keeping copies of your passport in a different location from the original, in case of loss or theft.

You are responsible for obtaining and paying for all visas and entry documents independently, for meeting all health and other requirements, and for any documents required by the laws, regulations, orders, and/or requirements of the countries you will visit. adesum is not responsible for providing you with specific visa and passport information or documentation, and adesum cannot accept liability for any passenger refused entry onto any transport or into the country due to failure of the passenger to carry correct documentation. All passengers traveling internationally are required to have a passport. Most countries require that the passport be valid for at least six (6) months beyond the conclusion of your trip. It is recommended you have a minimum of three blank pages in your passport when traveling, as many countries require blank pages. The process of obtaining a visa and/or passport can take up to three months or more.

Information on health services and insurance etc is normally available from your local or national Department of Health offices. We advise that anyone who is not in general good health, or is pregnant, or elderly, or suffers from any condition should only travel with their doctor’s consent, and you should ensure that they bring correct medicines and prescription details.

Force Majeure and liabilities

adesum is responsible solely for coordinating tour-related services and goods that are specifically included within an agreed upon tour itinerary.

We cannot accept liability or pay compensation if we are unable to undertake our obligations as a result of any event outside our control. Events beyond our control include industrial or civil unrest, inclement weather, fire, terrorism, war, natural disaster etc. Where these occur, we will attempt to provide you with an alternative on the same date or will offer you an alternative date. No refunds will be made in these circumstances and if the service provided is of greater value, you will have to pay the difference where applicable. Any additional charge may be covered by your insurance policy.

We will ensure that all parts of the trip you have booked (as per the booking confirmation) are honored and that these are performed to a high standard. We accept responsibility for the actions of our employees and suppliers but not for any injury caused to any member of your party through their own actions or inactions.

Law and jurisdiction

adesum may need to make changes to these Terms and Conditions. Any changes can only be made by us and not any third party member. We reserve the right to amend or improve these Terms and Conditions without prior notification. When it is necessary for changes to be made, we will forward you a copy of these changes and all reservations will abide by the amended terms, with the exception of reservations already made.

These terms and conditions are governed by Spanish law and all matters arising therefrom shall be subject to the exclusive jurisdiction of courts located in Madrid, Spain.
